Terms of Service

These Terms of Service (“Terms”) govern your access to and use of GinBox AI (the “Service”), operated by GinBox AI (“GinBox AI”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

GinBox AI is a web-based platform for AI-assisted visual content creation. You build a three-dimensional scene — placing environments, characters, objects, and a camera — and generate photorealistic images and storyboards from it. The Service is provided on a subscription basis and evolves over time; features may be added, changed, or removed.

2. Eligibility & Accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
• You are responsible for the accuracy of the information you provide and for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Subscriptions, Billing & Refunds

• The Service offers Free and paid subscription plans (currently Creator and Studio). Each plan includes a monthly allowance of image renders and features, as described on our pricing page.
• Paid subscriptions are billed on a recurring basis and renew automatically until cancelled. You may cancel at any time; access continues until the end of the current billing period.
• Payments are processed by Lemon Squeezy, our authorized reseller and Merchant of Record, who handles the transaction, invoicing, and applicable taxes. Your purchase is also subject to Lemon Squeezy’s terms.
• Except where required by law, fees are non-refundable. We may change plan prices or allowances with reasonable prior notice; changes apply to subsequent billing periods.

4. Your Content & Uploads

• You retain ownership of the images, prompts, and other materials you upload or create (“Your Content”).
• You grant us a limited license to host, process, and transmit Your Content solely to operate and improve the Service (for example, sending it to the AI infrastructure that generates your frames).
• You represent that you have all necessary rights to Your Content and that it does not infringe the rights of others or violate any law.

5. AI-Generated Output

• Subject to these Terms and your payment of applicable fees, you own the images and storyboards you generate (“Output”) and may use them for personal or commercial purposes.
• AI Output is generated probabilistically. We do not guarantee that Output is unique, accurate, or free of similarity to other results, and you are responsible for reviewing Output before relying on or publishing it.

6. Acceptable Use

You agree not to use the Service to create, upload, or distribute content that:

• is illegal, infringes intellectual property, or violates privacy or publicity rights;
• depicts a real, identifiable person without their consent, or is intended to deceive or impersonate;
• is sexually explicit involving minors, or is otherwise abusive, hateful, harassing, or harmful;
• attempts to disrupt, reverse-engineer, overload, or gain unauthorized access to the Service.

We may suspend or terminate accounts that violate this section.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by GinBox AI and protected by law. These Terms do not grant you any right in our intellectual property except the limited right to use the Service.

8. Third-Party Services

The Service relies on third-party providers for payments, hosting, and AI processing. Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services we do not control.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, GinBox AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold GinBox AI harmless from any claims, damages, or expenses arising from Your Content, your use of the Service, or your violation of these Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Provisions that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules, and the competent courts of Israel will have exclusive jurisdiction, unless mandatory law provides otherwise.
